<\/strong><strong>SCOPE<\/strong><\/a><strong> <\/strong><\/h1>\n\n\n\n<p>These rules and regulation apply to all <a>registered members of The Valke Rugby Referee society<\/a>.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>2.&nbsp;&nbsp; <\/strong><strong>PURPOSE<\/strong><\/a><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>The Valke Rugby Referee Society undertakes to uphold\ndisciplinary procedures that are fair, just, and equitable for all its members.\n<ul><li>The main purpose of these regulations are to provide\nguidelines in addressing unacceptable behaviour and or conduct.&nbsp; <\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>3.&nbsp;&nbsp;\n<\/strong><strong>TERMONOLOGY APPLICATION<\/strong><\/a><strong><\/strong><\/h1>\n\n\n\n<p><strong><em>SARU<\/em><\/strong>: Means\nthe South African Rugby Union.<\/p>\n\n\n\n<p><strong><em>SARRA<a>:\n<\/a><\/em><\/strong>Means\nthe South African Rugby Referee Association consisting of ordinary members and\nassociate members.<\/p>\n\n\n\n<p><strong><em>VRRS: <\/em><\/strong>Means\nthe Valke Rugby Referee Society consisting of registered members.<\/p>\n\n\n\n<p><strong><em>Person (s)<\/em><\/strong>:\nMeans a registered member who is the subject of the hearing.<\/p>\n\n\n\n<p><strong><em>The Office<\/em><\/strong>:\nRefers to the Valke Rugby Referee Society who administrates VRRS disciplinary\nprocesses.<\/p>\n\n\n\n<p><strong><em>Inquiry<\/em><\/strong>:\nThe process of investigating any alleged or apparent breach or contravention of\nan alleged offence referred to in 4.1 below.<\/p>\n\n\n\n<p><strong><em>Disciplinary Hearing<\/em><\/strong>: A\nformal hearing conducted by VRRS.<\/p>\n\n\n\n<p><strong><em>Disciplinary Committee<\/em><\/strong>: Means\na committee established in accordance with 6 below.<\/p>\n\n\n\n<p><strong><em>Hearing co-ordinator<\/em><\/strong>: Is\nan appointed person who co-ordinates Disciplinary Hearing proceedings.<\/p>\n\n\n\n<p>Unless the context otherwise requires, words used in\nthis document implying the singular shall include the plural and vice versa,\nand words implying the masculine gender shall include the feminine gender and\nvice versa.<strong><br>\n<\/strong><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>4.&nbsp;&nbsp; <\/strong><strong>BREACH OF\nTHE BYE-LAWS OR REGULATIONS<\/strong><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li><ul><li><ul><li><\/li><\/ul><\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>5.&nbsp;&nbsp; <\/strong><strong>JURISDICTION\nTO ADJUDICATE<\/strong><\/a><strong>\n<\/strong><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li><a>5.1.&nbsp;&nbsp;&nbsp;\nAn alleged breach, contravention or offence mentioned in 4.1 above must\nbe made in writing setting out full details of the alleged breach,\ncontravention or offence, and must be received by the Vice Chairperson: Administration\nnot later than thirty (30) days following the notifying party having knowledge\nof the alleged breach, contravention or offence.<\/a><\/li><\/ul>\n\n\n\n<p>5.3 At the\ncompletion of the Inquiry the Vice Chairperson: Administration in consultation\nwith the Valke Rugby Union shall, depending on the seriousness of the offence, decide whether to\nhave the matter adjudicated in accordance with these regulations or in accordance\nwith the Valke Rugby Union Disciplinary and Judicial Matters Regulations. Valke Rugby Union will have the final say in this regard. <\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>6.&nbsp;&nbsp; <\/strong><strong>THE\nAPPOINTMENT OF THE DISCIPLINARY COMMITTEE<\/strong><\/a><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>The\nDisciplinary Committee will consist of three (3) members appointed by the\nExecutive Management Committee from registered members and or from any persons with\nspecialist skills and experience as required, whether such persons are\naffiliated to VRRS or not.<ul><li>The\nChairperson of the Disciplinary Committee shall have appropriate experience in\ndisciplinary matters.<\/li><\/ul><ul><li>The\nChairman of the Disciplinary Committee shall have the power exercisable in his discretion,\nto co-opt onto the Disciplinary Committee from time to time additional <a>persons with specialist skills and experience as required,\nwhether such persons are affiliated to VRRS or not<\/a>.<\/li><\/ul><ul><li>By\nserving as a member of the Disciplinary Committee he shall not have a conflict\nof interest.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>7.&nbsp;&nbsp; <\/strong><strong>EVIDENCE<\/strong><\/a><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>The\nDisciplinary Committee shall be entitled to receive evidence in such form as it\nthinks fit (including evidence in writing), notwithstanding the evidence may\nnot be legally admissible and shall be entitled to attach such weight to that\nevidence as it\/he sees fit.<ul><li>First-hand\naccounts from persons present at the hearing as to their observations of the\nincident in question are to be preferred. <\/li><\/ul><ul><li>Hearsay\nevidence may be accepted. However, caution will be exercised before hearsay\nevidence is accepted in preference to first hand evidence and generally less\nweight is likely to be given to hearsay evidence.<\/li><\/ul><ul><li>The\nDisciplinary Committee should not permit the introduction of opinion evidence\nother than expert opinion evidence. Expert opinion evidence is only likely to\nbe permitted when the evidence falls outside the everyday knowledge of members\nof the Disciplinary Committee.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>8.&nbsp;&nbsp; <\/strong><strong>THE HEARING\nCO-ORDINATOR<\/strong><\/a><strong><\/strong><\/h1>\n\n\n\n<p>The Hearing co-ordinator performs\nall the logistical requirements pertaining to the hearing including but not\nlimited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Arrange\na time, date and venue for the hearing suitable to every party;<ul><li>Identify\nand arrange attendance at the hearing of all witnesses on behalf of VRRS;<\/li><\/ul><ul><li>Arrange\nan interpreter if required;<\/li><\/ul><ul><li>Record\nthe Hearing; and<\/li><\/ul><ul><li>Circulate\nthe finding of the Disciplinary Committee to the Person and relevant parties.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>9.&nbsp;&nbsp; <\/strong><strong>COURSE OF\nTHE DISCIPLINARY <\/strong><\/a><strong>PROCEDURE\nINCLUDING THE HEARING<\/strong><strong><\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>GENERAL:Disciplinary\nCommittee shall be fully autonomous and, in particular, any decision they make\nshall be binding on the Person, his\/their Provincial Referee Society, Valke\nRugby Union, SARU and SARRA, none of whom shall have the power to revoke or\nalter any decision.The\nrules of nature justice shall apply at all times which will include but not\nlimited to advising the Person timeously of the charge in writing, sufficient\ntime to prepare his defence, to be allowed a formal hearing and to be present\nat a formal hearing.A Person\nshall be allowed to be represented at a formal hearing by a colleague of his\nchoice or a legal representation at his own costs.All\ncost related to witness (es) called by a Person shall be the responsibility of\nthe Person.If required,\nan interpreter, who shall be a member of VRRS or any employee of the Valke\nRugby Union, shall be appointed. All\nhearings shall take place in private.Hearings\nby The Disciplinary Committee (save for private deliberations) may be fully audio\nor audio-visually recorded. The record of proceedings and all papers associated\nwith the proceedings shall be held for a suitable period by The Office under\nwhose jurisdiction the hearing took place and who shall promptly make same\navailable to VRRS or the Valke rugby Union on request.The\nstandard of proof for all matters shall be on the balance of probabilities.All\nquestions to a witness (es) shall be directed via the Chairperson.Any\nprocedures, findings or decisions of the Disciplinary Committee pursuant to\ndisciplinary processes under these regulations shall not be quashed or\ninvalidated by reason only of any departure from the procedural Regulations,\ndefect, irregularity, omission or other technicality unless such departure,\ndefect, irregularity, omission or technicality raises a material doubt as to\nthe reliability of the findings or decisions of these bodies or results in a\nmiscarriage of justice.A\ndecision of a Disciplinary Committee shall be valid if taken by at least a\nsimple majority of the members of the Disciplinary Committee. No member of the\nDisciplinary Committee may abstain from any decision. Where a Committee has an\neven number of members and they are unable to reach an unanimous or majority\ndecision, then the Chairman of the Disciplinary Committee shall have a casting\nvote.<\/strong><ul><li><strong>PRE HEARING PROCEDURES<\/strong><ul><li>The\nDisciplinary Committee shall be entitled to conduct a pre-hearing for the\npurpose of:<ul><li>&nbsp;Determining procedures.<\/li><\/ul><ul><li>&nbsp;The\nrequirement for any person to attend the hearing as a witness.<\/li><\/ul><ul><li>&nbsp;Confining\nthe matters in dispute.<br>\n<\/li><\/ul><\/li><\/ul><ul><li>Where\na disciplinary hearing is pending, a Person (s) may, prior to the hearing, be\nrequired by the Disciplinary Committee to:<ul><li>supply it \/ him with full particulars of the\ncase that will be presented on the Person\u2019s behalf at the hearing<\/li><\/ul><ul><li>supply it \/ him with full particulars of all witnesses\nintended to be called by the Person (s);<\/li><\/ul><ul><li>provide it \/ him with copies of any documents or\nreports that may be relied on by the Person (s) at the hearing; and<\/li><\/ul><ul><li>comply with such reasonable directions as shall\nbe considered appropriate by the Disciplinary Committee.<\/li><\/ul><\/li><\/ul><\/li><\/ul><ul><li><strong>DISCIPLINARY HEARING WHEN A PERSON ATTENDS<\/strong>:&nbsp;&nbsp;\n<ul><li>At\nthe start of the hearing the Disciplinary Committee shall ask the Person\nwhether he has any objections to the appointment of the members to the\nDisciplinary Committee.<\/li><\/ul><ul><li>The\ncharge(s) will be read to the Person. <\/li><\/ul><ul><li>The\nPerson will be given the opportunity to enter a plea of guilty or not guilty to\nthe charge(s).<\/li><\/ul><ul><li>The\nPerson may admit the offence at any time in which case The Disciplinary\nCommittee should accept and record same and proceed to hear submissions in\nrelation to sanction.<\/li><\/ul><ul><li>If\nthe Person pleads not guilty, VRRS\u2019s case will be put to the Person, evidence\nwill be led and witness (es) called (if applicable).<\/li><\/ul><ul><li>The\nPerson will have the opportunity to ask questions to the witness (es) via the\nchairperson.<\/li><\/ul><ul><li>The\nPerson will then have the opportunity to call witness (es) and to lead evidence.<\/li><\/ul><ul><li>The\nDisciplinary Committee may question the Person\u2019s witness (es).<\/li><\/ul><ul><li>After\nall the evidence has been heard, the Chairperson gives the Person the\nopportunity to summarise his case.<\/li><\/ul><ul><li>The\nChairperson may now adjourn the hearing for the Disciplinary Committee to reach\na decision.<\/li><\/ul><ul><li>The\nChairperson now makes the finding known and gives reasons for the decision.<\/li><\/ul><ul><li>The\nPerson is given the opportunity to give evidence in mitigation and submissions\nregarding an appropriate sanction.<\/li><\/ul><ul><li>The\nChairperson adjourns the disciplinary hearing for the Disciplinary Committee to\ndecide on an appropriate sanction.<\/li><\/ul><ul><li>The\nChairperson conveys the sanction to the Person and gives reasons for the\ndecision.<\/li><\/ul><ul><li>The\nChairperson informs the Person of his right to appeal.<\/li><\/ul><ul><li>The\nChairperson will send the written report to the office, preferable within seven\n(7) days from date off the Disciplinary Hearing where after a copy will be sent\nto the Person.<\/li><\/ul><ul><li>The\nwritten report will be kept on the Person\u2019s personal file.<\/li><\/ul><\/li><\/ul><ul><li><a>9.4.&nbsp;&nbsp;&nbsp; <strong>DISCIPLINARY HEARING WHEN THE PERSON DOES\nNOT ATTEND<\/strong><\/a><strong>:<\/strong><ul><li>The\nDisciplinary Committee shall endeavour to ensure that disciplinary proceedings\nare heard in the presence of the Person who is the subject of the proceedings.<\/li><\/ul><ul><li>Nothing\nin the Regulations, or otherwise, shall prevent a Disciplinary Committee to\nconduct a hearing in the absence of a Person. Hearings may only be held in the\nabsence of a Person if that Person have been given the opportunity to attend\nand he subsequently declined the opportunity without a reasonable excuse or if\nhe consented to a hearing in absentia. In such circumstances, the Disciplinary\nCommittee may consider any written representations in making its decision.<\/li><\/ul><ul><li>The\nHearing co-ordinator of the Disciplinary Hearing will provide all written\nrecords as proof that the Person was informed to attend the Disciplinary\nHearing and such records will be kept on the Person\u2019s personal file.<\/li><\/ul><ul><li>At\nthe hearing, the Chairman may consider all evidence whether submitted prior to\nor during the hearing. <\/li><\/ul><ul><li>The\nfollowing steps will take place during a Disciplinary Hearing in absentia of\nthe Person:<ul><li>The charge(s) will be read out.<\/li><\/ul><ul><li>The Hearing co-ordinator will provide evidence\nsubstantiating VRRS\u2019s case.<\/li><\/ul><ul><li>The Disciplinary Committee evaluates the\nevidence.<\/li><\/ul><ul><li>The Chairman may adjourn the hearing to reach a\ndecision regarding the Person\u2019s guilt or innocence.<\/li><\/ul><ul><li>In the event of a guilty finding, the Disciplinary\nCommittee will consider all aggravating and mitigating evidence prior to\nimposing a sanction.<\/li><\/ul><ul><li>The Chairman may adjourn the hearing to decide\non a sanction if applicable.<\/li><\/ul><ul><li>The Chairman makes the sanction known and gives a\nreason for the decision.<\/li><\/ul><\/li><\/ul><ul><li>The\nChairperson will send the written report to the office, preferable within seven\n(7) days from date off the Hearing where after a copy will be sent to the\nPerson.&nbsp;<\/li><\/ul><ul><li>The\nwritten report will be kept on the Person personal file at The Office.<\/li><\/ul><\/li><\/ul><\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><strong>10.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n<\/strong><strong>PENALTIES<\/strong><\/a><strong> <\/strong><\/h1>\n\n\n\n<ol class=\"wp-block-list\"><li>In event of a breach of the Bye-Laws and the Regulations\nRelating to the Game of World Rugby; the Constitution, Codes of Conduct, Rules\nand Regulations and decisions of SARU and\/or Valke Rugby Union and\/or SARRA and\/or\nVRRS and or other entity to which VRRS is affiliated, the Disciplinary\nCommittee shall be entitled to impose such penalties as they think fit.
